You must have an Instagram account. You may create an Instagram account by accessing Instagram at http://instagram.com and following the instructions to create an account for free. Information you provide to Instagram to open an account and use the app is subject to Instagram’s privacy policy, located at http://instagram.com/about/legal/privacy/.

Once you have an Instagram account, To enter the Promotion, entrants must, during the Promotion Period:

• (1) Post a picture or reel of your coin(s) or bars to your Instagram account.
• (2) Use #GovMintSunday in the caption of your post(s).

Entry Limits: Entries posted with all required information within the Promotion Period will receive one (1) entry into the Promotion. More than one (1) entry per household will be accepted. Any entries posted after 11:59 a.m. on day the Promotion ends will not be considered. Incomplete, garbled, corrupted, or illegible entries are void and will not be accepted. The sponsor is not responsible for lost, late, damaged, delayed, destroyed, misdirected, or incomplete entries. All entries become the property of the Sponsor. Persons discovered entering under multiple identities will be disqualified. Sponsor reserves the right to disqualify false entries or entries suspected of being false. In the event of a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the Instagram account was opened. The use of any device or software to automate the entry process is prohibited.

By entering the Promotion, you (i) represent and warrant that you have read and accepted these Official Rules; (ii) agree to be bound by the decisions of the Sponsor, which are final and binding; and (iii) understand that you may be contacted by the Sponsor to inform you that you are the winner, how to receive your prize, and otherwise by Sponsor in accordance with the terms of its Privacy Policy.

Prize One (1) “Prize” will be awarded to one (1) potential winner consisting of:

• One (1) 2018 Golden State Mint 1-oz Silver Aztec Calendar Round BU (ARV: $33.95)

Prize Draw: The winner will be determined in a random drawing to be held on or about April 3, 2023 (“Promotion Drawing Date”) from among all eligible entries posted during the Promotion Period. Sponsor’s selection of the winner and all decisions regarding this Promotion are final, binding, and non-appealable.

Within one (1) week following the Promotion Drawing Date, Sponsor will contact the potential winner by direct message on Instagram. Entrants must set their Instagram profile to public (not private) in order to receive Sponsor's notice.

Should the potential winner not reply to Sponsor within 48 hours, or if the potential winner does not otherwise comply with the Promotion requirements or return required winner verification documentation, that potential winner will be deemed to have forfeited any rights to his or her Prize and Sponsor will have the right to select an alternate potential winner from among the remaining eligible entries. Before being officially declared the Winner, a selected entry will be verified by Sponsor. Sponsor reserves the right to require proof of age and compliance with these Official Rules prior to awarding any Prize. The Sponsor retains the right, in its absolute discretion, to make substitutions of equivalent kind or value in the event of the unavailability of the Prize for any reason. The decisions of Sponsor on all issues relating to the Promotion will be final and binding on all entrants.

Winner Verification: All Prize claims are subject to verification by the Sponsor and/or its designated representatives. Any attempted form of entry other than as described herein is void. Sponsor will be the sole and final reference source in validating the Prize claim.

Privacy and Publicity Release: Any personal information supplied by entrants to Sponsor, or its affiliates, will be subject to Sponsor’s Privacy Policy located at https://www.moderncoinmart.com/privacy-policy/. Except where prohibited by law: (1) an entrant’s entry and/or a winner’s acceptance of the Prize constitutes permission for the Sponsor to use a winner’s name/address (city and state), photo, likeness, biographical information, statement, voice for advertising/publicity purposes worldwide and in all forms of media (including posting on www.moderncoinmart.com or social media outlets run or managed by Sponsor), in perpetuity, without further notice to or compensation in connection with said Promotion or the prize awarded; (2) Sponsor has the right to modify, edit, adapt, electronically alter, use, assign and/or dispose of such entries however it sees fit and for any purpose without any notice or compensation to entrant or any third parties; and (3) your submission of an entry in the Promotion constitutes your agreement to be contacted by Sponsor by mail, email, telephone or other means to for marketing and/or promotional purposes, and otherwise in accordance with Sponsor’s Privacy Policy.

Force Majeure: Sponsor reserves the right to cancel, terminate, or suspend this Promotion, or award any prize, in its sole discretion, in the event a computer virus or bug, unauthorized human intervention, pandemic, quarantine, virus or any other occurrence beyond its control corrupts or adversely affects the administration, security, or normal operation of the Promotion, or for any other reason within Sponsor’s deems necessary and reasonably, in its sole discretion.

Release/ Disclaimer of Liability: By participating in the Promotion, entrants agree to release, discharge, and hold harmless Sponsor its parent companies, affiliates, and subsidiaries, as well as any advertising companies, promotion agencies, or other individuals engaged in the development or execution of this Promotion from any liability, claims, losses, and damages arising out of or relating to their participation in this Promotion or the acceptance, use, misuse, or possession of any Prize received in this Promotion. Furthermore, winner agrees to sign a liability waiver form to this effect. The liability waiver will also include an authorization to use the winner’s name for advertising purposes. Sponsor is not liable for faulty computer components, software, or links, the loss or nonexistence of communications capability, or faulty, incomplete, incomprehensible, or erased computer or network transmissions that render a Promotion entrant ineligible for the Promotion. Sponsor is also not liable for any damage or loss that may be caused directly or indirectly, in whole or in part, by the downloading of any software or form or the transmission of any information regarding entering the Promotion.

Disputes: All claims arising out of or relating to this Promotion will be governed by the Minnesota law, excluding Minnesota’s conflict of laws rules, and will be litigated exclusively in the courts of Minneapolis, Minnesota. You expressly consent to personal jurisdiction in those courts. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION. YOU HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.

No Waiver: Sponsor’s failure to enforce any provision in these Official Rules shall not constitute a waiver of that provision.

Winner’s List: To request a list of winners, or for any other questions regarding this Promotion, within 120 days after the start of the Promotion Period, send a stamped, self-addressed envelope (except where prohibited) and a note identifying the name of this Promotion to Sponsor Asset Marketing Services, LLC dba GovMint at GovMint, ATTN: Legal Dept, 1300 Corporate Center Curve, Eagan, MN 55121.
